The Human Rights Division of the High Court in Accra has on Wednesday, July 8, 2026, declined an ex-parte application filed by lawyers for former National Food and Buffer Stock Company (NAFCO) Chief Executive Officer, Hanan Abdul-Wahab Aludiba, seeking an order to compel the Bureau of National Investigations (BNI) and the Attorney General to produce him in court.
The application, led by former Attorney General Godfred Yeboah Dame, argued that Mr. Aludiba had been unlawfully detained since his arrest on July 4, 2026, without being charged.
The lawyers urged the court to order the BNI and the Attorney General to produce their client and justify his continued detention, describing the matter as urgent and a violation of his constitutional rights.
However, the presiding judge, Justice Barbara Tetteh-Charway, ruled that the court could not hear the application without first giving the respondents an opportunity to respond.
She explained that the allegations raised required both the BNI and the Attorney General to be heard before any order could be made, adding that the court did not have the full facts surrounding the case.
Mr. Dame argued that more than 78 hours had passed since his client’s arrest and maintained that the continued detention without charge breached Article 14(3) of the 1992 Constitution.
He also told the court that an ex-parte order would not prevent the respondents from later explaining the reasons for the detention.
The judge, however, directed the legal team to pursue a motion on notice that had already been filed, saying the decision was consistent with the law.
The case has been adjourned to July 10, 2026, for the motion on notice to be heard.
This development comes days after the deputy Attorney-General, Justice Srem-Sai revealed in a Facebook post on Sunday, July 4, 2026 that the Former Chief Executive Officer of the National Food Buffer Stock Company (NAFCO), Hanan Abdul-Wahab Aludiba, has been arrested at the Accra International Airport after allegedly attempting to access funds in a frozen bank account while preparing to leave Ghana.
According to Dr Sai, Abdul-Wahab had earlier secured permission from the High Court to travel abroad for a few days, even though he is currently standing trial on charges of stealing and causing financial loss to the Republic.
