NCA Case: Supreme Court dismisses two applications

The Supreme Court has dismissed two applications filed by Counsels for Former Board Chair of the National Communication Authority, Eugene Baffoe Bonney, Former Director General, William Tevie and three others.
The applications were first for an order of certiorari to determine whether a page in a whole document can be tendered in evidence and the second whether the Court acted right by holding a part of the case in camera.
Counsel for the Former Director General of the NCA, Thaddeus Sory argued that there were no facts for the High Court to determine whether the issue bothers on National Security.
He said it’s a clear violation of the Constitution saying the public should have been allowed to be part of the proceeding. The Director of Public Prosecution, Yvonne Attakorah Obuobisa also argued saying the Court relied on Article 19(15) which gives its discretion to hold a case in camera.
She said the High Court acted within its jurisdiction. The Apex Court of the land ruled that the High Court acted within its jurisdiction and dismissed the case accordingly.
The Former Board Chair of the NCA, Eugene Baffoe Bonney, Former Director General, William Tetteh Tevie and three others are before the Court for willfully causing financial loss to the state to the tune of four million dollars.
