Ofosu Ampofo case adjourned to December 7, 2021

The Commercial Division of the Accra High Court has adjourned the case of the Republic vs Samuel Ofosu Ampofo and one other to the 7th of December to continue with cross examination.

Earlier on Monday, November 1, the investigator in the case, Chief Inspector Bernard Berko, was cross examined by Defence Counsel Tony Lithur.

Mr Lithur questioned the investigator why he charged the second accused person when his voice was on the said tape.

Mr Berko told the court that he did charge him because he conspired with the first accused person. He further told the court that the second accused person granted an interview with Adom FM and he said that he was part of the meeting and agreed to what the first accused person, that is Mr. Ofosu Ampofo said.

He answered in the negative when asked whether in his opinion anybody at that meeting was part of the said plot. Mr. Lithur then asked whether he had read through the transcript of the interview the second accused person conducted with Adom FM.

He positively replied, ‘You caused to be Prepared as part of your investigation a transcript of the interview A2 gave to Adom FM and transcript of radio interview from Adom FM’, Lawyer Lithur questioned: “you will say that it is an accurate transaction”? Counsel again directed the witness to go through the transcript which has been tendered as an exhibit and point out to the court where exactly the second accused person said he agreed to and supported what the first accused person had said”.

The investigator who took about ten minutes to read through the transcript identified Pages one and five of the transcript and read to the court. Lawyer Lithur said that this is a plot to commit an offence.

The second accused was interviewed, the tape was played to him and he said everything the first accused person said is acceptable and they support it. The court presided over by Justice Asiedu, a court of appeal judge sitting with additional responsibility as a high Court judge however Adjourned the case to the 7th of December, 2021 for further Cross-Examination. The National Chairman of the NDC Samuel Ofosu Ampofo is standing trial with one Kwaku Boahen over alleged leaked audio.

Mr Ampofo has been charged with Conspiracy to cause harm and two counts of assault against a public officer and Mr. Boahen is facing one count of Conspiracy to cause harm.
