International Criminal Court member states voted Friday at United Nations headquarters in New York to dismiss chief prosecutor Karim Khan. The secret ballot resulted in 82 of the court’s 125 member states voting in favour of removing Khan. The court’s oversight body concluded that Khan committed a serious breach of duty and serious misconduct. The inquiry found he engaged in an improper sexual relationship with a junior staff member and sought to stop her from pursuing her complaint. Khan was suspended last month pending this final determination by member states. His removal marks an unprecedented moment for the permanent war crimes tribunal.
Accusations and Legal Defense
The allegations against Khan surfaced during investigations into claims brought by a junior female staff member who worked directly for him. The accuser, known publicly as Sarah, detailed a gradual boundary violation. In an interview, she stated that she felt humiliated, noting that there was the pawing, the physical nature of it, but it did not start that way because it was kind of like encroachments on the boundaries slowly, not just physically but emotionally as well. She added that there is no way for something to be consensual when you have such a power disparity, and that Mr. Khan was not just my boss, he was everyone’s boss.
Khan has consistently and vehemently denied all wrongdoing. In a previous interview, he maintained that he completely denied engaging in any harassment, abuse of authority, inappropriate behavior whatsoever, while also highlighting that he cooperated with the investigation. His legal team heavily criticized the proceedings, describing his suspension and removal as unlawful, procedurally unfair and unsupported by evidence. His defense team asserted that Khan’s removal was determined by a process in which he was never given a fair opportunity to be heard, adding that they know of no court or tribunal in any proper and fair legal system that bars a person facing the gravest professional sanction from being heard.
Geopolitical Pressures and Investigations
The ouster unfolds amid a turbulent backdrop of high-stakes international politics and direct conflict with major global powers. In May 2024, Khan sought arrest warrants for top Hamas leaders as well as Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant over alleged war crimes and crimes against humanity linked to the Gaza war. The timing sparked intense speculation regarding potential state-sponsored efforts to discredit the prosecutor, though Sarah strongly denied allegations that she acted as a state actor or intelligence asset for Israel.
The United States, which is not an ICC member, reacted sharply to the court’s actions. Washington imposed economic sanctions on Khan and multiple court officials. American diplomatic hostility intensified with broader campaigns aimed at dismantling the tribunal’s jurisdiction over non-member nationals. Israeli officials welcomed the decision, with Israel’s ambassador to the United Nations stating that Karim Khan believed that by launching a political witch hunt against Israel and issuing a politically motivated arrest warrant against Prime Minister Netanyahu, the world would ignore the grave sexual misconduct allegations against him, concluding that he was wrong.
Institutional Fallout and Future Outlook
Supporters of international justice fear the tribunal will emerge severely damaged from the internal crisis. The exhaustive inquiry reviewed thousands of pages of evidence compiled through a United Nations Office of Internal Oversight Services investigation. Despite the leadership vacuum created by the dismissal, legal experts confirm that existing arrest warrants and ongoing investigations remain valid because only the court’s judges hold the authority to alter or withdraw them. The Assembly of States Parties must now navigate the complex task of selecting a replacement while shielding the vulnerable institution from external political dismantlement.
