An official opinion piece from the Office of the Attorney-General and Ministry of Justice addressed to the Chairman of the Committee on Constitutional, Legal and Parliamentary Affairs on the government’s position on the Promotion of Proper Human Sexual Rights and Ghanaian Family Values Bill, 2021, says some portions are unconstitutional and violate fundamental human rights.

The 18-Page Memoranda which was in response to the Committee’s request for government’s position on the Bill dated October 19, 2022 states that some parts of the Bill will violate some fundamental human rights and freedoms such as the right to Privacy, Right to Freedom of Expression, Freedom From Discrimination and it is liable to face some fundamental challenges during its implementation.

The Bill in its current form seeks to criminalise all activities of the LGBTQI+, promotion of or advocacy and funding of their activities in the country, and makes any union of persons of the same sex illegal. The bill also charges the ordinary citizens and relevant stakeholders and constitutional bodies to uphold and promote and protect Ghanaian family values.
