Supreme Court dismisses application challenging Afoko’s bail revocation

A five-member panel presided over by Justice Jones Dotse has dismissed an application by lawyer for Gregory Afoko seeking the Apex court to quash the decision of the High court in the revocation of his bail and prohibiting the judge from hearing the case.

 Lead counsel for the applicant, Safo Buabeng told the court that the mere filing of Nolle Prosequoi does not terminate proceedings.

According to him, by statute, the accused must be discharged by the court, but his client has not been discharged and has been arraigned before another court on the same charge sheet.

Deputy Attorney General Godfred Yeboah Dame said it is incorrect to say that a High Court decision cannot be reversed by another, therefore, the argument by his colleague, Safo Buabeng is unmeritorious and has no basis.

 The court after listening to both sides concluded that the application lacks merit and dismissed it.
