GBA calls for revocation of Chief Justice’s suspension, cites Constitutional breach

The Ghana Bar Association (GBA) has called for the immediate revocation of the suspension of the Chief Justice of the Republic of Ghana, deeming the action unconstitutional and lacking the necessary legal framework.

At its 2025 Mid-Year Conference held at the Labadi Beach Hotel on April 26, the Association expressed grave concern over what it described as a breach of constitutional provisions. According to the GBA, the President’s decision to suspend the Chief Justice under Article 146(10) of the 1992 Constitution was executed without a Constitutional Instrument or Statutory Regulation, as required by Article 296.

The Bar emphasized the urgent need for comprehensive regulations to govern such actions, urging Parliament to enact clear legal frameworks to ensure transparency and fairness in matters concerning the suspension or impeachment of Superior Court Justices.

In addition, the GBA demanded the immediate release of the full decision that allegedly established a prima facie case against the Chief Justice. They argued that transparency in this matter is vital to uphold public confidence in the Judiciary.

The Association also condemned politically motivated or prejudicial commentary that threatens judicial independence, vowing to defend the integrity of the Judiciary through all lawful means.

These resolutions form part of broader efforts by the GBA to uphold the rule of law and protect the sanctity of Ghana’s democratic institutions. The issue is expected to generate significant public and political debate in the coming days.
