Legal analyst, Austin Kwabena Brako-Powers has warned that the conduct of state institutions could weaken Ghana’s case in any attempt to extradite former Finance Minister Ken Ofori-Atta.
Speaking on GTV’s ‘Current Agenda’: Your Voice, Your Power, Mr. Brako-Powers said inconsistent public messaging and procedural missteps could create the impression that authorities are uncertain about their own legal strategy.
He noted that questions over whether proceedings could continue without the physical presence of the former minister reflected a lack of clarity that may be exploited by defence lawyers.
“When state institutions appear unsure whether the accused must be present or not, it raises credibility issues and can waste valuable time,” he said.
According to him, extradition requests are scrutinised carefully by foreign courts, and any sign of procedural weakness could undermine the state’s position.
He cautioned that credibility, consistency and strict adherence to procedure are essential if Ghana hopes to succeed in such high-profile international legal actions.
