No evidence Former Finance Minister Ken Ofori-Atta is a flight risk — Immigration Lawyer

US Immigration lawyer, Benedicta Agyemang has revealed that the US government, particularly the Department of Homeland Security, DHS, has failed to provide documents to support claims that former Finance Minister, Ken Ofori-Atta is a flight risk. 

 Benedicta Agyemang said the agency told the judge that Ofori-Atta should be considered a flight risk because of an ongoing extradition process, but did not submit supporting documents to establish that claim.

“DHS failed to provide documentation showing that Ofori-Atta is a flight risk after telling the judge to consider him as such due to the ongoing extradition process”, she noted.

Speaking on GBC’s ‘Current Agenda’ via zoom today, she stated that the court gave the agencies 30 days to file the required documentation. On the 30th day, they submitted a document, but it did not meet the legal requirement set by the court.

She explained that Mr. Ofori-Atta has been granted bail set at $65,000, emphasizing that this does not affect the merits of the case and that he is still obligated to appear in court.

Her remarks relate to ongoing legal proceedings involving Mr Ofori-Atta, including concerns raised in court about possible flight risk and documentation issues. The situation follows his stay in the United States since late December 2024 or early January 2025, where he sought medical treatment. According to his lawyers, he underwent surgery after being diagnosed with prostate cancer.

On January 6, 2026, he was detained by U.S. Immigration and Customs Enforcement at the Caroline Detention Facility in Bowling Green, Virginia. Reports indicate he was taken into custody at a luxury apartment in Washington, D.C., with assistance from the FBI.

He was released from ICE detection on April 7, 2026.
