FDA defends ban on celebrity alcohol adverts

The Food and Drugs Authority (FDA) says it is standing firm on its controversial restriction preventing celebrities from endorsing alcoholic beverages, arguing that the policy is rooted in public health and not a violation of constitutional rights.

Speaking at the FDA’s 2024 Annual Stakeholder Meeting in Accra, the Director of Legal Services, William Kobla Agbavitor, disclosed that the Authority currently has over 17 criminal cases pending across its regional operations. These cases, he said, reflect the FDA’s strengthened legal enforcement in protecting consumers from unsafe products and harmful practices.

On the celebrity alcohol endorsement ban, Mr. Agbavitor explained that while some entertainers see the restriction as an infringement on their freedom of expression and economic activity, the Authority views it as a necessary safeguard against youth exposure to harmful influences.

“Celebrities are influencers. Whatever they endorse begins to pick up immediately, even without extensive research. The level of influence they have over the public, especially the youth, makes unrestricted alcohol promotion a danger to public health,” he stressed.

Mr. Agbavitor urged industry players, including entertainers and businesses, to familiarize themselves with the laws and regulations before engaging in trade or promotional activities.

“Ignorance of the law is no excuse. Before entering into any business, it is prudent to understand the regulatory framework. That is the only way to avoid the ramifications of violations,” he advised.

The FDA’s legal department says it will continue to monitor, prosecute, and enforce compliance while maintaining policies that prioritize public health over commercial interests.
