Supreme Court throws out NAM1’s latest bid to stop his trial

The Supreme Court has dismissed an application seeking to halt the trial of Nana Appiah Mensah, also known as NAM1, the Chief Executive Officer of the defunct Menzgold Ghana Limited, who has been accused of defrauding the company’s customers.

The application had earlier been dismissed by the High Court, where it was first filed, and again by the Court of Appeal before reaching the Supreme Court.

NAM1 and two of his companies, Menzgold Ghana Limited and Brew Marketing Consult Ghana Limited, have been charged with 39 counts of selling gold without a licence, operating a deposit-taking business without a licence, inducement to invest, defrauding by false pretence, fraudulent breach of trust and money laundering.

The allegations relate to customer losses of GH¢340,835,650 between 2016 and 2018.

NAM1 has pleaded not guilty to all the charges. He is on bail of GH¢500 million with four sureties.

In 2024, the High Court ordered him to open his defence. After the ruling on the submission of no case, his lawyers filed an appeal seeking to overturn the directive and also applied for a stay of proceedings.

The trial court dismissed the application for a stay of proceedings. His lawyers then turned to the Court of Appeal, which also rejected the request.

Not satisfied with the Court of Appeal’s decision, they filed a fresh application at the Supreme Court, which has now been dismissed.
