The 2024 NDC Parliamentary Candidate for the Kpandai Constituency, Daniel Nsala Wakpal, has filed an application at the Tamale High Court seeking to have the Chairperson of the Electoral Commission (EC), Mrs. Jean Mensa, committed to prison for contempt of court.
The application, brought under Article 99 of the 1992 Constitution and Section 16 of the Representation of the People Act (PNDCL 284), alleges that the Electoral Commission has failed or refused to comply with a High Court order directing a rerun of the Kpandai Parliamentary Election within thirty days.
According to the motion and supporting affidavit, the High Court, presided over by Justice Emmanuel Bar Plange Brew, on 24 November 2025, ordered a fresh parliamentary election in the constituency after Mr. Wakpal successfully challenged the earlier declaration of Matthew Nyindam as Member of Parliament-elect.
Court records indicate that the EC was served with the court’s order on 25 November 2025, but the applicant contends that the Commission has since “shown no sign of adhering” to the directive.
Mr. Wakpal argues that the Commission’s conduct amounts to a deliberate disobedience of a lawful court order, which, in his view, “interferes with the due administration of justice” and satisfies the legal test for contempt.
“My Counsel has advised me, and I verily believe, that an act is contemptuous when a person goes contrary to the order of a competent Court,” the affidavit states, emphasizing that the EC’s continued inaction is “contemptuous of this Honourable Court.”
The application therefore seeks an order citing and committing the EC Chairperson for contempt, asserting that the Commission’s alleged refusal to conduct the rerun election within the stipulated timeframe undermines the authority of the court.
The High Court is expected to hear the application on the 23rd of this month.
