The Deputy Attorney General, Justice Srem-Sai, has confirmed that the Attorney General’s Department will comply with a High Court order to take over all criminal cases being handled by the Office of the Special Prosecutor.
The directive follows a ruling by an Accra High Court on April 15, which declared all ongoing prosecutions by the OSP null and void unless authorised by the Attorney General. The court also ordered that all such cases be transferred to the Attorney General’s Department.
In a Facebook post on April 16, Dr Srem-Sai said the government would respect the decision and begin steps to implement it.
He stated that the Attorney General has no intention of disobeying the court and will take the necessary actions to enforce the ruling in the coming days.
The decision marks a significant shift in the handling of corruption-related prosecutions in Ghana, temporarily returning prosecutorial authority from the OSP to the Attorney General.
Meanwhile, the OSP, led by Kissi Agyebeng, has announced plans to challenge the ruling, setting the stage for a legal contest over its powers.
The outcome of the case is expected to shape the future role and independence of the OSP.
