The Ghana Bar Association (GBA) has broken its silence on the ongoing constitutional process for the removal of the Chief Justice of Ghana, following her recent suspension by President John Dramani Mahama.

In an official statement released today, the GBA acknowledged receiving three petitions calling for the Chief Justice’s removal and noted that two related cases are currently before the Supreme Court, challenging the legality of the process.

The Association, through its General Council, affirmed its commitment to upholding the rule of law, the independence of the judiciary, and the spirit of the 1992 Constitution.

It emphasized that the removal process, outlined in Article 146 (6)–(10) of the Constitution, must be strictly adhered to. This includes the formation of a five-member investigative committee by the President in consultation with the Council of State.

“It is expected that persons who play even the minutest role in this process will bear in mind Article 296 of the 1992 Constitution and act in a manner that safeguards the independence and image of the Judiciary,” the statement read.

Signed by GBA National Secretary, Kwaku Gyau Baffour, the statement called for all stakeholders to be guided by the tenets of the rule of law and to act in accordance with the nation’s democratic values.

The GBA assured the public that it will continue to play its constitutional role by defending the integrity of Ghana’s legal system and ensuring justice is administered without fear or favour.
