OSP moves to challenge High Court ruling on prosecution powers

The Office of the Special Prosecutor (OSP) says it is taking urgent legal steps to overturn a High Court ruling that ordered the Office of the Attorney-General to take over all criminal cases being handled by the agency.

The decision, delivered on Wednesday, April 15, 2026, by Justice John Nyante Nyadu, has sparked debate over the extent of the OSP’s authority to prosecute cases independently. The court also awarded costs of GH¢15,000 against the anti-corruption office.

In a statement issued shortly after the ruling, the OSP strongly disagreed with the decision, arguing that the High Court had gone beyond its legal powers. It insisted that only the Supreme Court of Ghana has the authority to declare parts of a law unconstitutional.

The Special Prosecutor, Kissi Agyebeng, and his office said they are actively pursuing legal remedies to have the ruling set aside as soon as possible.

Despite the court’s directive, the OSP assured the public that all its ongoing and planned prosecutions remain valid under the Office of the Special Prosecutor Act, 2017 (Act 959).

The office maintained that its work will continue in line with the law until the Supreme Court makes a final determination on the matter.
