Government affirms commitment to judicial independence amid Chief Justice suspension controversy

The Government of Ghana has reiterated its commitment to constitutional governance and the independence of the judiciary following reactions from the Minority in Parliament over the suspension of Her Ladyship Chief Justice Gertrude Araba Esaaba Sackey Torkornoo.

The Minority Caucus, in a strongly worded statement, described the President’s action as a “brazen judicial coup” and alleged that the suspension was politically motivated.

They called for the immediate reinstatement of the Chief Justice and urged the government to halt all removal proceedings until the Supreme Court rules on the constitutionality of the ongoing process.

However, government officials have clarified that the action taken is well within the framework of Article 146 of the 1992 Constitution, which outlines the procedures for addressing complaints against high-ranking judicial officers.

The decision, made in consultation with the Council of State, is part of a constitutionally-mandated process and does not in itself constitute a dismissal or final decision on the matter.

Legal experts have urged all parties to respect due process and refrain from politicizing the matter. They highlighted that the Supreme Court is already seized with legal challenges related to the procedure, and its eventual ruling will guide the way forward.

Meanwhile, the Presidency has encouraged calm and cooperation among all stakeholders, reiterating that Ghana’s democratic institutions remain strong and resilient.

The statement added that government remains fully committed to upholding the rule of law, judicial independence, and good governance in the interest of all Ghanaians.

While Parliament continues to play its oversight role, the Executive has urged public and political actors to allow the legal processes to run their course without undue interference or speculation.

The matter remains under judicial review, and Ghanaians are encouraged to maintain confidence in the constitutional processes that safeguard the country’s democracy.
