Sekondi High Court affirms Dorcas Affo-Toffey as MP for Jomoro

A Sekondi High Court has dismissed the election petition challenging the eligibility of the Member of Parliament (MP) for Jomoro, Dorcas Affo-Toffey to contest the 2020 Jomoro Parliamentary seat.

The petition brought by a citizen of Jomoro, Joshua Emuah Kofie alleged the MP at the time of her election was a dual citizen and therefore did qualify to contest the election.

The Court presided over by Dr Justice Osei Hwre in dismissing the case said Article 48 of the Ivorian Nationality Code makes it clear that, once an Ivorian national takes another citizenship,  he or she automatically loses the Ivorian nationality.

He also averred that, the Petitioner through his Lawyer did not object to the claims and credentials of  the expert witness who came from Ivory Coast to testify on behalf of the First Respondent.

However, the Court did not award cost based on an agreement the parties had not to seek for cost.

Madam Affo-Toffey who was obviously happy with the judgement commended her legal team and party fateful for the support.

For his part, the Lawyer for the Petitioner, Frank Davies said justice emanates from the Courts and would not go for appeal.

Lawyer for Madam Affo-Toffey, Edudzi Tamakloe said the judgement speaks for itself and the defence team agrees with the  Court.

He expressed gratitude for the support.
