The Accra High Court has refused another attempt by MP for Assin North James Gyakye Quayson to suspend his criminal trial.
His Lead counsel, Tsatsu Tsikata, told the court last Friday to halt the criminal proceedings against Mr. Gyakye Quayson on the grounds that he had filed two separate applications at the Court of Appeal and the Supreme Court.
The application at the Court of Appeal is an appeal against the High Court’s earlier decision not to Stay Proceedings pending an appeal.
The one at the Apex Court is invoking its supervisory jurisdiction by way of certiorari and prohibition to order the High Court to halt the trial until the prosecution furnishes the defence with all relevant documents it will rely on for the trial of the MP.
The Trial judge, Justice Mary Yanzuh, dismissing the request held that notwithstanding the pendency of those applications, the trial can proceed until an order from a superior court. She said pending applications do not automatically warrant a stay of proceedings.
In view of that, she ordered that the cross-examination of the first Prosecution witness should continue.
