Ofori-Atta to be arrested upon arrival in Ghana – Deputy Attorney-General

The Deputy Minister of Justice and Attorney-General, Justice Srem Sai, has hinted that embattled former Finance Minister Kenneth Nana Yaw Ofori-Atta will be arrested immediately upon his arrival in Ghana.

Dr. Sai said this in response to a question posed to him by Lawyer Kofi Bentil, the Vice President of IMANI Africa, who sought to know whether Mr. Ofori-Atta would be detained upon arrival.

“Ken Ofori-Atta will be arrested upon entry, and he will then be taken through the process and granted bail, etc.,” he further explained.

The Deputy Attorney-General, speaking on The Key Points, a current affairs programme on TV3 on Saturday, January 10, 2026, said that Ghana’s Ministry of Justice and the Attorney-General’s Department were part of the process that resulted in the detention of Ken Ofori-Atta in the United States.

He said that the Ghanaian authorities collaborated with U.S. law enforcement agencies on the matter.

“We are keenly involved in this matter. We collaborate with law enforcement agencies in this matter,” Justice Srem Sai retorted.

The United States Immigration and Customs Enforcement (ICE) has detained Mr. Ken Ofori-Atta regarding the status of his current stay in the United States.

This is contained in a Public Notice issued by Mr. Ofori-Atta’s lawyers, Menka-Premo, Osei-Bonsu, Bruce-Cathline, and Partners on January 7, 2026.

The notice said the U.S. legal team is in contact with ICE and expects the matter to be resolved expeditiously.

“Mr. Ofori-Atta has a pending petition for adjustment of status, which authorizes a person to stay in the U.S. legally past the period of validity of their visa. Under U.S. law, a change of status by this method is common,” the lawyers explained.

“The public is therefore advised to note that Mr. Ken Ofori-Atta, as a law-abiding person, is fully cooperating with ICE to have this issue resolved,” a portion of the release said.

Mr. Ofori-Atta is wanted by the Attorney-General and the Office of the Special Prosecutor for offences related to the SML Deal, National Cathedral project, and others.
